I. Subject of the conditions of participation

1. HONEST CATCH GmbH, Leopoldstraße 171, 80804 Munich is organizing a competition.
2. The competition takes place annually from January 1st. (0:00 a.m.) until December 31st. (11:59 p.m.) of the current year (hereinafter referred to as the “competition period”).
3. The following conditions of participation and the data protection notice apply to participation in the competition within the competition period. By participating in the competition, you agree to the validity of these terms and conditions and the data protection regulations.
4. Participation is free of charge and is not linked to a purchase obligation.

II. Eligibility

1. All natural persons aged 18 and over residing in Germany and Austria are eligible to participate.
2. Employees of HONEST CATCH GmbH and their relatives as well as employees of companies affiliated with HONEST CATCH GmbH within the meaning of Section 15 AktG and their relatives are excluded from participating in the competition. Persons involved in the technical and/or organizational implementation are also excluded.
3. Participation in the competition is voluntary. There is no entitlement to participate in the competition.
4. Participation in the competition is free. However, the usual fees of the respective telephone/internet providers may apply.

III. Profit / profit processing

1. The following prizes will be raffled off among all entries after the competition period has ended:

• 10 x HONEST CATCH vouchers worth 150.00 € each

IV. Participation in the competition

1. Take photos of what you have cooked with your seafood delicacies.
2. Post your best photo on the social network “Instagram” and use the hashtag #honestcatch. To do this, you must have a user account or set up such an account.
3. Participation in the competition is from January 1st. (0:00 a.m.) until December 31st. (11:59 p.m.) of the current year possible.
4. It is possible to post multiple photos per participant to increase the chance of winning.

V. Determination of the winners; win notification; Obligation to
Return message

1. A jury will select the winners from among all entries within 2 weeks of the end of the competition participation period.
2. If you win, the winner will receive a notification of the win as a personal message on Instagram. By taking part in the competition, participants expressly agree to this type of contact in the event of a win.
3. Feedback and acceptance of the prize must be declared immediately, but no later than 24 hours after receipt of the prize notification, in writing to shop@honest-catch.com or via Instagram private message in response to the prize notification. In this declaration it is necessary to provide HONEST CATCH with the following data: Full name (first and last name); Birth date; E-mail address 4. In the event that the winner does not respond to the prize notification within the period specified in Section V No. 3 of these Terms and Conditions of Participation, a replacement winner will be determined within the following 24 hours in accordance with Section V No. 1-3 of these Terms and Conditions of Participation.
5. The prize will be sent to the winner by email to the email address provided within 14 days. The winner is responsible for updating their contact details (especially their email address). Any disadvantages resulting from providing incorrect and/or incomplete contact details (e.g. incorrect email address) will be borne by the winner. HONEST CATCH GmbH is not obliged to provide the correct contact details.
6. If someone has been chosen as the winner (or replacement winner), but it is not possible to accept the prize for legal or factual reasons, the prize will be forfeited without replacement.

VI. Exclusion from participation in the competition; interruption or
early termination of the competition

1. HONEST CATCH GmbH is entitled to exclude participants who are suspected of violating these terms and conditions from participating in the competition. The use of technical or other unauthorized aids is not permitted when participating in the competition. HONEST CATCH GmbH is entitled to exclude participants from participating in the competition in the event of manipulation of any type or extent and without providing further reasons. This also applies if someone has already been identified as a winner or has declared acceptance of the prize; In this case, the prize is lost or can be reclaimed by HONEST CATCH GmbH.
2. If you have been chosen as the winner and it is not possible for you to accept the prize or participate for legal or factual reasons or due to a subsequent exclusion in accordance with Section VI No. 1 of these conditions of participation, or if the prize is for reasons that are within your area of ​​responsibility of the winner cannot be transmitted, the prize will be forfeited without replacement.
3. HONEST CATCH GmbH is entitled to interrupt or prematurely cancel or end the competition at any time without prior notice if

• the competition is stopped by Instagram or
• the competition can no longer be carried out properly due to failure of hardware or software, program errors, computer viruses or unauthorized interventions by third parties, taking into account the legitimate interests of the participants' already posted posts.

VII. Rights

1. The participants assure HONEST CATCH GmbH that they are the rights holders for all texts, images and/or videos they upload. Furthermore, we guarantee that these submissions do not infringe any rights of third parties; This includes in particular third-party copyrights or personal rights of the people depicted. The participants undertake to indemnify HONEST CATCH GmbH from all third-party claims arising from the violation of such rights within the scope of the agreed use by HONEST CATCH GmbH and from legal costs.
2. The above-mentioned transmission to HONEST CATCH GmbH takes place free of charge; There is no entitlement to compensation or reimbursement of expenses.

VIII. Liability

1. HONEST CATCH GmbH is liable in the context of the implementation of the competition - regardless of the legal basis - only for intent or gross negligence. HONEST CATCH GmbH is only liable for slight negligence in the event of a breach of obligations that are essential for participation in the competition (cardinal obligations), but in these cases the amount is limited to the value of the possible prize. Cardinal obligations are those obligations that make proper participation possible and on whose compliance the participant can regularly rely. These limitations of liability also apply in the event of negligence on the part of employees and vicarious agents of HONEST CATCH GmbH. The limitations of liability do not apply to personal injuries.
2. HONEST CATCH GmbH endeavors to ensure trouble-free operation of the competition and to keep the competition available as long as possible. However, HONEST CATCH GmbH points out that complete, seamless availability of the competition is not technically feasible. HONEST CATCH GmbH does not guarantee that the competition will operate smoothly. In particular, HONEST CATCH GmbH is free to restrict access to the competition, in whole or in part, temporarily or even permanently, due to maintenance work, capacity issues and other events that are beyond its control.
3. HONEST CATCH GmbH is not liable for damages that may arise from errors, delays or interruptions in transmission, disruptions to the technical systems and the service, incorrect content, loss or deletion of data, viruses or in any other way during participation , unless such damage is caused intentionally, grossly negligently or by breach of cardinal obligations by HONEST CATCH GmbH or its vicarious agents. This exclusion of liability does not cover damages resulting from injury to life, body or health. Warranty claims regarding the prize are excluded from HONEST CATCH GmbH and/or companies affiliated with HONEST CATCH GmbH.
4. There is no further entitlement to maintain individual functionalities or to maintain the competition itself.

IX. Data protection notice

1. In the event of a win, the communication of personal data in accordance with Section V No. 3 of these conditions of participation serves to determine the winner (first and last name) and eligibility to participate (date of birth) and to process the prize (email address). The data transmitted to HONEST CATCH GmbH as part of the competition will be completely deleted after the competition has ended and been processed and the statutory retention periods have expired.
2. Participants are free to revoke their consent to data processing at any time by sending an email to shop@honest-catch.com and thus withdraw from participation. If the participant revokes their participation in the competition ends with immediate effect.
3. Participants have the right to request information free of charge about the personal data stored by HONEST CATCH GmbH (Article 15 GDPR). Participants also have the right to request correction, deletion or restriction of the processing of their personal data (Articles 16-18 GDPR) as well as the right to receive relevant data in a structured, common and machine-readable format (right to data portability, Art. 20 GDPR). Participants can object at any time to data processing that is necessary to protect the legitimate interests of HONEST CATCH GmbH or a third party or that is carried out for the purpose of direct advertising (Art. 21 GDPR). If a participant is of the opinion that the processing of personal data concerning them by HONEST CATCH GmbH contradicts relevant legal provisions, they can also contact a supervisory authority, in particular in the member state of their place of residence or the place of the alleged violation. X. Instagram notices and conditions

1. In addition to these terms and conditions of participation, the relationship between HONEST CATCH GmbH, the participants and Instagram is determined by the Instagram terms of use and Instagram's data protection rules.
2. Participants cannot assert any claims against Instagram that arise in connection with participation in the competition.
3. The participants are aware that the competition is not connected to Instagram and is in no way sponsored, supported or organized by Instagram ( https://www.instagram.com ).
4. All inquiries and information regarding the competition should be directed to HONEST CATCH GmbH at shop@honest-catch.com .

XI. Final provisions

1. Legal recourse is excluded.
2. Only the law of the Federal Republic of Germany applies, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (UN Convention on Contracts for the International Sale of Goods). If you are a consumer, this choice of law only applies to the extent that it does not take away the protection granted by mandatory provisions of the law of the country in which you habitually reside (principle of favourability).
3. If any of these participation regulations are or become ineffective, the remaining regulations remain unaffected. The ineffective regulation will be replaced by the one that comes closest to the originally intended purpose of the regulation.
